The following document constitutes the binding legal agreement (hereinafter the “Agreement”) between Palais Mirage d’Atlas, Mirage d’Atlas Gestion SARL, its parent corporations, representatives, property owners, and subcontractors (hereinafter collectively referred to as the “Hotel”, “Property”, “Estate”, or “Management”), and the individual, individuals, or corporate entity executing the reservation and utilizing the accommodation services (hereinafter referred to as the “Client”, “Guest”, or “Party”).
By engaging the digital infrastructure of www.miragedatlas.com, executing a reservation, submitting financial compensation, or physically occupying the premises, the Client unreservedly acknowledges, understands, and legally agrees to be bound by the entirety of the stipulations, operational policies, and liability limitations detailed herein. Clients who book a suite or villa are conclusively deemed to have accepted this rental agreement and its terms and conditions in their entirety. By booking a suite, clients acknowledge their absolute responsibility and agree to all the aforementioned terms and conditions without exception.
1.1 Occupancy Timelines: The Client is legally entitled to assume occupancy of their reserved accommodation beginning at 3:00 PM (15:00 hours local time) on the scheduled date of Check-In. The Client is legally obligated to surrender the premises, removing all personal effects, vehicles, and personnel, no later than 12:00 PM (12:00 hours local time) on the scheduled date of Check-Out. Any deviations from these timelines require explicit, prior written approval from the Management.
1.2 Pet Prohibition: Pets and animals of any classification are strictly and unequivocally forbidden on the property. Any attempt to introduce an animal to the Estate will result in the animal and the Client being immediately denied entry. In such events, the reservation will be deemed unilaterally canceled by the Client without eligibility for a refund.
1.3 Child Policies and Demographics: For the purposes of accommodation provision, supervision requirements, and financial assessment, the Hotel categorizes occupants under the following strict age brackets:
Babies: Individuals under 3 years old.
Children: Individuals between 3 and 12 years old.
Adults: Individuals 12 years and above.
1.4 Property Quiet Times: To preserve the tranquil environment of the luxury estate, Clients are kindly advised, and legally obligated to respect, that the Hotel’s mandatory quiet times are in strict effect from 22:00 (10:00 PM) to 08:00 AM.
2.1 Property Taxes and Fees: The Client explicitly understands and acknowledges that government accommodation tax may not be included in the advertised baseline price of the room and is strictly subject to mandatory payment upon physical arrival at the Estate. Pursuant to Moroccan municipal and federal law, the Client is legally responsible for the payment of the following statutory levies:
Government Tourism Tax: 30.00 MAD per person, per night.
Touristic Promotion Tax (TPT): 11.00 MAD per person, per night.
2.2 Payment Processing Surcharges: The execution of financial transactions via credit or debit networks incurs infrastructural merchant acquiring costs. The Client agrees to the imposition of the following non-refundable processing surcharges on all card-based payments:
All payments made with a VISA, MASTERCARD, or other standard network card are subject to a 2.7% processing surcharge.
All payments made with an AMERICAN EXPRESS (AMEX) card are subject to a 4.7% processing surcharge.
3.1 Financial Instrument Matching: To combat international financial fraud, the Client understands and legally agrees that the payment method utilized must strictly match the name registered on the booking. Using a payment method that does not correspond to the reservation name may lead to the immediate cancellation of the booking, without refund, unless explicitly approved in advance by our Management team.
3.2 Documentary Evidence and Verification: The Client is strictly required to fill in the attached, formal document titled “Card Authorisation”. This completed document must be sent via electronic mail to [email protected] along with a clear, unredacted copy of their physical passport to definitively prove legal ownership of the card.
3.3 Physical Presentation: The exact physical credit or debit card used to secure and book the reservation must be physically present and presented to the Management upon arrival at the Estate. Failure to present the physical card will result in the immediate rejection of the authorization form and the potential denial of entry.
4.1 Standard Cancellation Penalty: A full charge for the entire stay (100% forfeiture) applies if the reservation is canceled within 42 days of the scheduled arrival date.
4.2 Administrative Friction Fees: Please note that all executed cancellations, regardless of their proximity to the arrival date or theoretical eligibility for a refund, are subject to a mandatory administrative fee of 3% of the total reservation amount or €50, whichever value is higher. The Client explicitly acknowledges that bank fees and currency conversion mechanisms are not eligible for a refund under any circumstances.
4.3 No-Show Policy: No-shows (failure to arrive without accepted prior communication) will incur an immediate, non-reversible 100% charge of the total amount due for the entire duration of the booked stay.
4.4 Pre-Authorization Rights: The Hotel unequivocally reserves the right to pre-authorize financial instruments or fully debit the payment prior to the end of any theoretical free cancellation period to secure funds. All discretionary refunds are subject entirely to the Hotel’s discretion.
4.5 Group Booking Policy: Group bookings represent significant inventory risk and are subject to stringent financial requirements.
For bookings of three (3) rooms or more, a 50% non-refundable deposit will be strictly required at the time of reservation. The remaining balance for these bookings is due 45 days before arrival.
For large group reservations, clients must provide a 50% non-refundable downpayment upon reservation, and the remaining balance must be paid in full three months (90 days) before the scheduled arrival date.
Clients must obtain pre-authorization from the property management for stays requiring three or more rooms. Failure to declare this requirement or to respond to an inquiry regarding group stays may result in the immediate cancellation of the reservation.
5.1 Marital Documentation Requirement: In strict adherence to Moroccan operational policies and the mitigation of liabilities associated with the Moroccan Penal Code, any Moroccan couples must present legally valid marriage certificates upon arrival. Failure to present this documentation will result in immediate denial of entry to the Estate. In such an event, clients explicitly waive the right to any refunds and are legally compelled to pay for the entirety of their stay.
5.2 Absolute Prohibition of Illicit Activities: The drug trade, recreational drug use, and prostitution are severely punished by Moroccan law. Any non-compliance with the law, or suspicion of such activities, may result in the immediate expulsion of the Client and their party from the hotel without compensation, and the notification of local authorities.
6.1 Injury and Damage Liability: Mirage d’Atlas is unequivocally not responsible for compensating clients for any personal injury, illness, fatal accident, death, loss, or damage of whatever nature suffered by them or any member of their party during the booking period or thereafter.
6.2 Assumption of Risk: The Client agrees that they are solely and exclusively responsible for their own physical safety, including the use of high-risk hotel facilities such as the gym, swimming pools, and landscaped grounds.
6.3 Parental Responsibility: Parents and legal guardians are absolutely responsible for the physical safety, continuous supervision, and behavior of their children during their stay on the property.
6.4 Special Dietary Requirements: Clients who require vegetarian or vegan meals, or meals that adhere to specific allergens, may request them from the hotel’s cook. However, it is the absolute legal responsibility of the client to clearly, accurately, and thoroughly communicate any relevant or life-threatening allergies to the hotel staff. The Estate assumes no liability for allergic reactions. Furthermore, the Estate requires the client to mention the allergy to the property prior to arrival by email to [email protected], then further mention it to the member of staff upon arrival, then prior to ordering, and finally confirm it once receiving the meal prior to consumption. Missing any of these steps indemnifies Mirage d’atlas.
6.5 Damage to the Hotel and its Contents: Clients are financially and legally responsible for any damage to the Suites, Villas, or property contents that has occurred due to negligence, willful damage, intoxication, or irresponsible behavior on the part of those occupying the hotel or their invited guests. Damage must be immediately reported to Mirage d’Atlas or its representative, and the Client must pay for the absolute cost of the replacement or damage prior to departure. Should the client depart prior to the discovery of their damage, they explicitly approve the charge of their card on file.
7.1 Rights of Access: Clients should be legally aware that Mirage d’Atlas, their direct representatives, or their sub-contractors retain the unconditional right of access to the property at any time. This access is reserved to inspect the premises and carry out essential, emergency, or routine repair or maintenance work. Whenever operationally feasible, Clients will be notified in advance of any necessary access.
7.2 Responsibilities and Disclaimers: Neither Mirage d’Atlas nor its representatives can be held legally responsible or financially liable for any circumstances beyond their direct control. This explicitly includes, but is not limited to: mechanical breakdowns of property infrastructure, sudden staff illnesses, swimming pool maintenance, the emergency emptying of the swimming pool for necessary health and safety maintenance, or the failure of any municipal public service supply (electricity, water, telecommunications).
7.3 Force Majeure: The hotel cannot accept liability or pay any financial compensation where the performance or prompt performance of their contractual obligations is prevented, delayed, or affected by ‘Force Majeure’. For the purposes of this Agreement, ‘Force Majeure’ means any event the supplier of the service(s) in question could not foresee or avoid, even with the application of due care.
7.4 Mandatory Travel Insurance: Travel insurance against booking cancellation, personal accident, emergency repatriation, and medical expenses is absolutely not included in the hotel hire cost. It is a fundamental condition of booking that clients independently take out comprehensive travel insurance, as it is exclusively their personal responsibility to do so.
8.1 Complaints Resolution: Clients are strongly advised to report any operational complaints regarding Mirage d’Atlas, its staff, or its physical contents immediately to the hotel manager during their stay. The hotel will take commercially reasonable steps to resolve the matter in real-time on behalf of clients and in liaison with the owner of the property. Please note, and be legally advised, that Mirage d’Atlas and its representatives categorically cannot be held liable for complaints submitted after the completion of the hire period and the Client’s departure from the Estate.
8.2 Governing Law: This Agreement, and any disputes arising from the reservation, the interpretation of these terms, or the physical stay at the Estate, shall be governed by and construed exclusively in accordance with the sovereign laws of the Kingdom of Morocco.
8.3 Jurisdiction: Both parties irrevocably agree that the competent courts of the Kingdom of Morocco, Marrakech, shall possess exclusive jurisdiction to hear, determine, and resolve any legal proceedings, lawsuits, or disputes arising out of or in connection with these Terms and Conditions.
